Read Chapter 17: THE TRIAL
Nathan Vale’s trial began three months after the landing.
The timing offended everyone in a different way. Asterion wanted the case postponed so the company could enjoy reflected glory. Prosecutors believed the landing made the fraud easier to explain: success did not erase false certifications. Defense attorneys argued the opposite—that the successful mission proved the disputed engineering decisions had been reasonable.
Luc was subpoenaed.
On the witness stand, the courtroom seemed smaller than any review room and more dangerous. Technical language became ammunition as soon as it entered the record.
The prosecutor showed the jury the MidSouth rejection report.
“What does this mean, Mr. Moreau?”
“It means the relay lot exhibited intermittent open circuits under combined elevated temperature and vibration and was rejected for critical continuity service.”
“Could such an open circuit affect spacecraft operation?”
“Yes.”
“How?”
“In the configuration under review, it could interrupt conditioned power to control electronics long enough to force a reset or unpredictable state transition.”
The defense attorney rose on cross-examination.
“Mr. Moreau, did any astronaut die because of this relay?”
“No.”
“Did any crewed spacecraft fail because of it?”
“Not that we identified.”
“Did Apollo 11 land successfully?”
“Yes.”
“Then your warnings were hypothetical.”
Luc looked at him.
“All engineering warnings about failures that have not yet happened are hypothetical.”
A few jurors smiled.
The attorney changed direction.
“Is it true the original vibration test was disputed because of fixture resonance?”
“Yes.”
“So reasonable engineers disagreed.”
“They disagreed about some acceleration amplification. The power dropout tracked the hardware.”
“But there was disagreement.”
“Yes.”
“And the repeat test passed.”
“At reduced input below the required qualification level.”
“Again, a judgment call.”
“No. A judgment call would have been to record the first failure, explain the fixture concern, record the reduced rerun and ask the program to decide whether the evidence was sufficient. What happened was that the first result disappeared from the final qualification record.”
The attorney paused.
Luc continued before he could be stopped.
“Engineering can survive bad judgment. It cannot survive counterfeit evidence.”
The judge instructed him to answer only the question asked.
During a recess, Hale found him in the hallway.
“You rehearsed that?”
“No.”
“Pity. It was good.”
The trial lasted four weeks.
Pike testified that Vale had instructed managers to prevent test anomalies from triggering contractual redesign unless failure could be reproduced under project-controlled conditions. Susan Bell testified that she had warned Vale’s office that vendor requalification was unsupported.
Then the defense produced internal NASA correspondence showing that some agency managers had encouraged contractors to resolve anomalies without formal change requests whenever possible.
The revelation complicated everything.
Vale’s attorneys argued he was being scapegoated for a culture NASA itself had created.
Luc read the newspaper reports and felt the old discomfort return.
Vale was guilty of decisions Luc despised. But the system had rewarded those decisions until catastrophe made them inconvenient.
The jury convicted Vale on two counts of submitting false contract certifications and acquitted him on broader conspiracy charges.
He received a prison sentence measured in years, not decades.
Outside the courthouse, reporters asked Luc whether justice had been done.
He said, “A verdict is not a redesign.”
They printed it anyway.
Preparing for trial forced Luc to revisit every technical decision in hostile detail.
Government attorneys held mock cross-examinations. They challenged terminology, assumptions and memory. If Luc said a dropout was dangerous, they asked him to quantify dangerous. If he said the altered report concealed a failure, they asked whether the first run had been indisputably valid. If he called the relay defective, they reminded him that many units had operated without incident.
At first Luc became angry.
Then he recognized the value.
A design review and a courtroom shared one useful feature: both punished statements stronger than the evidence beneath them.
Hale sat through one preparation session.
When it ended, she asked, “Still certain?”
“More precise.”
“Better.”
Luc had entered the case wanting to prove a component unsafe. By trial, his conclusion had changed. The strongest claim was not that the relay would certainly fail in flight. It was that Asterion had denied the program the information needed to decide whether its demonstrated failure mode was acceptable.
The shift sounded smaller.
Legally and morally, it was larger.
Engineering rarely offered certainty. If fraud required certainty of catastrophe, almost no concealed risk could ever be punished before people died.
The duty was not to predict every accident.
It was to preserve evidence honestly enough that responsible people could choose risk with open eyes.
The trial also forced Pike to confront Luc in a way they had avoided since the investigation began.
They met in a courthouse cafeteria during a recess. Pike looked older than he had two years earlier.
“My attorney says I should blame Vale for everything,” he said.
“Will you?”
“I signed the rerun.”
“Yes.”
“I told Susan to close the waiver.”
“Yes.”
“I knew the first trace looked real.”
Luc waited.
Pike stared at his coffee.
“I kept telling myself I was protecting the team. Three thousand jobs. Maybe the whole division. You know what happens when a contractor misses milestones? People don’t talk about that in ethics seminars.”
“No.”
“You think I should have stopped it.”
“Yes.”
“Even if Asterion collapsed?”
Luc considered the answer carefully.
“I think you should have shown NASA the failure and let the program decide whether redesign was worth the cost. You took a decision that belonged to more people than you.”
Pike looked up.
“That is your whole philosophy, isn’t it?”
“Not mine. Systems engineering.”
Pike laughed once.
“God help us if systems engineering becomes morality.”
“Perhaps morality is just requirements with consequences.”
For the first time in years, Pike smiled genuinely.
“Still impossible.”
“Yes.”
